Erik and Lyle Menendez are striving for a release from incarceration before Thanksgiving, and their legal representatives have adopted a new approach aimed at securing the brothers’ freedom … they’re requesting clemency from the governor of California.
Mark Geragos, the attorney representing the Menendez brothers, appeared on “TMZ Live” this Tuesday, sharing his intention to submit documents today to appeal to Gavin Newsom for clemency.
Politickin’ with Gavin Newsom, Marshawn Lynch, and Doug Hendrickson
This is quite significant on its own, and sources linked to the Governor’s office indicate that they are aware of the clemency petition … which is notably interesting, especially since Newsom recently discussed the Menendez brothers on a podcast.
Governor Newsom commented on Erik and Lyle’s predicament while on “Politickin’ with Gavin Newsom, Marshawn Lynch, and Doug Hendrickson” … mentioning he was advised to pay attention to their case due to the Netflix documentary, and he commended Ryan Murphy for creating a captivating series.
Newsom indicated that he is currently reviewing recommendations from the parole board, along with pardons and commutations that do not pertain to the Menendez brothers … emphasizing that this time of year, prior to the holidays is when much of that work is accomplished.
Geragos also affirmed what we previously reported … that Erik and Lyle’s legal representatives are also intending to request the judge at their resentencing hearing to modify their conviction from murder to involuntary manslaughter, which would allow for their immediate release based on time they have already served.

Additionally, there is a new judge overseeing the case, and the forthcoming resentencing hearing is scheduled for next month … it appears that Geragos may be able to secure the release of Erik and Lyle sooner than anticipated.
The complete interview will be broadcast today on “TMZ Live.”
