Alec Baldwin recently achieved another win in the “Rust” shooting incident … as a judge denied the state’s appeal to revisit the case’s dismissal with prejudice.
The First Judicial District Court of New Mexico issued its ruling on Thursday, stating that several of the arguments posited by the prosecutors had already been articulated and did not reach the requisite standard for reconsideration of the judgement.
The judge further emphasized that despite the state submitting its documents by the deadline of August 30, the motion exceeded the permitted page limit without prior approval from the court.

The revised motion was lodged five days afterward — past the deadline for appeal … and the judge referenced this as an additional rationale for rejecting the motion.
We previously informed you about the revised motion submitted by Kari T. Morrissey last month … asking the judge to reconsider the dismissal of the case with prejudice so they could pursue prosecution against Baldwin again.

Within the motion, the prosecution contended that Baldwin’s legal team was aware of the live ammunition on set, and that this information was not pivotal to his defense.
As you may recall, during the proceedings, it was disclosed that the evidence of live ammunition was documented under a separate case number — and Baldwin’s attorneys argued this effectively concealed pertinent evidence from his defense team.
We have reached out to Baldwin’s representatives … but as of yet, we have not received a response.
