Alec Baldwin has achieved another win in the “Rust” shooting incident, as a judge has denied the state’s petition to revisit the earlier dismissal of the case with prejudice.
The First Judicial District Court of New Mexico delivered its ruling on Thursday, stating that many of the points raised by the prosecution had already been addressed and fell short of the standards necessary for reconsideration of the prior judgment.
The judge further remarked that although the state did submit its documents by the August 30 deadline, the motion exceeded the permitted page limit without seeking the court’s prior approval.

The revised motion was submitted five days later — beyond the designated timeline for appeal — which the judge referenced as an additional factor in rejecting the motion.
We previously reported on the revised motion submitted by Kari T. Morrissey last month, in which she sought for the judge to reconsider the dismissal of the case with prejudice in order to attempt a new prosecution against Baldwin.

In the motion, the prosecutor claimed that Baldwin’s team was aware of the live ammunition present on set, asserting that it was not a significant element of his defense.
As noted earlier, it was unveiled during the trial that the evidence regarding the live ammunition was cataloged under a different case number, which Baldwin’s defense argued effectively obscured the evidence from their attention.
