Positive developments for Erik and Lyle Menendez … the Los Angeles County District Attorney’s Office has informed us that they are open to reevaluating a conviction that could potentially liberate the brothers with a simple court ruling.
Here’s the situation … L.A. County D.A. George Gascón has submitted legal documents requesting Judge William C. Ryan to reconsider the sentences of the Menendez brothers during a hearing in November. If that occurs, they could qualify for immediate parole, contingent upon an affirmative verdict from the California Parole Board.
As reported by TMZ, we have learned that Erik and Lyle’s attorney, Mark Geragos, intends to urge the judge to alter their conviction from murder to voluntary manslaughter … under a recent statute, the judge is empowered to make such a change. Should this come to fruition, Erik and Lyle would find themselves as free individuals, as the maximum sentence they could serve is 11 years, yet they have already completed 35 years.
The Los Angeles County District Attorney’s Office has informed TMZ … “While we presently believe the evidence substantiates the first-degree murder charge, we’re still willing to review any new evidence and arguments put forth by the defense attorney.”

Considering the comments from the D.A.’s office, it appears they might be inclined to consent to changing Erik and Lyle’s conviction to voluntary manslaughter … a decision that could significantly alter their situation.
Another favorable condition for the Menendez brothers appears to be … L.A. County Superior Court Judge Ryan is known for his boldness and isn’t hesitant to overturn decisions made by other judges if he believes they are unjust.
It seems that fortune may be favoring Erik and Lyle at this moment.
